Webasto and Espar settle class action lawsuit over parking heaters

       The U.S. District Court for the Eastern District of New York announced that it has reached two settlement agreements with Webasto and Espar in a class action lawsuit worth up to $15 million.
        Named as defendants: Webasto Products North America Inc., Webasto Thermo & Comfort North America Inc. and Webasto Thermo & Comfort, Eberspaecher Climate Control Systems GmbH & Co. KG Espar Inc. and Espar Products Inc.
       According to the court, it was about whether Webasto and Espar were involved in an illegal conspiracy to artificially increase, repair, maintain and/or stabilize the prices of aftermarket autonomous heaters (heaters and accessories used to heat commercial vehicles).
       The court will hold a fair hearing on January 9 to decide whether the settlement should ultimately be approved.
       The Settlement Agreement applies to all individuals or entities that purchase American aftermarket space heaters, their territories or property directly from Webasto or Espar, or from any of their parent companies, predecessors, assigns, subsidiaries or affiliates, effective October 1, 2007 to December 31, 2007, 2012.
        The settlement agreement provides for automatic payments to class members. If class members are notified by mail and the settlement is approved, they will receive payment without filing a claim. Estimated payments will be calculated based on available purchase data.
